As reported by WIBX 950 in their article, “Driving High in New York? Here’s What the Law Says,” New York’s legalization of recreational marijuana in 2021 has raised concerns about impaired driving. Even if you’re an experienced cannabis user who believes you’re unaffected by its effects, the law doesn’t see it that way—driving under the influence of any substance, legal or not, carries serious consequences.

According to Sgt. Dave Olney of the New York State Police, officers trained in Advanced Roadside Impaired Driving Enforcement (ARIDE) can detect impairment beyond just the smell of alcohol or marijuana. If an officer suspects you’re impaired, you may be subjected to a field sobriety test followed by a blood test, which is considered the most accurate way to detect active marijuana impairment.
