As reported by JUSTIA in their article “Statues of Limitations in New York Car Accident Lawsuits,” as with the majority of claims, individuals have a set time frame that they are able to file their claim in. This timeframe is known as a statute of limitations.

“If a victim does not file their case within the applicable statute of limitations, the defendant probably will succeed in getting the case dismissed, regardless of how significant the injuries or costs were and how clear liability may be,” JUSTIA said.
